Cancellation and Refunds

1. Overview

At CurlShell, we understand that circumstances may change, and you may need to cancel a project or request a refund. This policy outlines our procedures for cancellations and refunds to ensure transparency and fairness for both parties.

2. Project Cancellation

2.1 Cancellation by Client

Clients may cancel a project at any time by providing written notice via email. The following terms apply:

  • Before Project Start: Full refund of any advance payment, minus a 10% administrative fee.
  • During Development: Refund will be calculated based on the percentage of work not yet completed.
  • After Milestone Completion: No refund for completed milestones; partial refund for incomplete work.

2.2 Cancellation by CurlShell

CurlShell reserves the right to cancel a project under the following circumstances:

  • Non-payment or delayed payment beyond agreed terms.
  • Client's failure to provide required materials or feedback within reasonable timeframes.
  • Requests for illegal or unethical content/features.
  • Breach of terms and conditions by the client.

In such cases, refund will be provided for work not completed, and payment will be due for work already delivered.

3. Refund Policy

3.1 Eligibility for Refund

Refunds may be considered in the following situations:

  • Project cancelled before any development work has begun.
  • Significant deviation from agreed project specifications not approved by client.
  • Extended delays caused solely by CurlShell beyond the agreed timeline.
  • Service not delivered as promised in the project proposal.

3.2 Non-Refundable Items

The following are generally not eligible for refund:

  • Completed development work or delivered milestones.
  • Third-party costs (domain registration, hosting, plugins, licenses, etc.).
  • Consultation fees and planning/discovery phase charges.
  • Rush or priority processing fees.
  • Custom design work already approved by the client.

4. Refund Process

  1. Request Submission: Submit a refund request via email to curlshellprivatelimited@gmail.com with your project details and reason for the refund.
  2. Review Period: We will review your request within 5-7 business days.
  3. Assessment: Our team will assess the work completed and calculate the eligible refund amount.
  4. Communication: We will communicate the decision and refund amount (if applicable) via email.
  5. Processing: Approved refunds will be processed within 10-15 business days to the original payment method.

5. Refund Calculation

Refund amounts are calculated based on:

  • Total project cost as per the agreement.
  • Percentage of work completed at the time of cancellation.
  • Any third-party costs already incurred.
  • Time and resources invested in the project.

A detailed breakdown will be provided with the refund decision.

6. Revisions and Disputes

Before requesting a refund due to dissatisfaction:

  • Please utilize the revision rounds included in your project package.
  • Clearly communicate your concerns so we can address them.
  • We are committed to working with you to achieve your desired outcome.

If a dispute cannot be resolved through revisions, both parties agree to attempt resolution through good-faith negotiation before any formal action.

7. Maintenance and Support Services

For ongoing maintenance or support subscriptions:

  • Monthly subscriptions can be cancelled with 15 days' notice before the next billing cycle.
  • Annual subscriptions can be cancelled, with refund prorated for unused months (minus a 15% early termination fee).
  • No refunds for the current billing period once services have been rendered.

8. Force Majeure

Neither party shall be liable for delays or cancellations due to circumstances beyond reasonable control, including natural disasters, pandemics, government actions, or other force majeure events. In such cases, both parties will work together to find a mutually acceptable solution.
